Condo Water Damage in Toronto: Who Repairs What Under the Condominium Act

Ontario condominiums are governed by the Condominium Act, 1998, along with each corporation's declaration, by-laws and rules. The Act divides a building into units, which owners hold individually, and common elements, which all owners share, and it sets default repair and maintenance duties. As a general rule, the corporation must repair the units and common elements after damage, while owners maintain their own units, but the declaration can shift some of those duties onto owners. That is why two Toronto buildings can handle an identical leak very differently, and why the first question a property manager asks is often not how much water there is but where it came from and what it reached. Before any restoration decision, it is worth asking the property manager for a copy of the declaration and any standard unit by-law, since those documents answer most of the questions that follow.

The concept that decides most condo water damage cases is the standard unit. A corporation can pass a by-law describing what a standard unit contains for each class of suite, typically the builder-grade flooring, drywall, cabinetry, doors and fixtures that were there when the building was registered. If there is no by-law, the Act and its regulations set out how the standard unit is determined. The corporation's obligation to repair after damage does not extend to improvements, meaning anything beyond that standard, such as upgraded hardwood, custom millwork, added pot lights or a renovated bathroom. Improvements are normally the owner's responsibility, which is why unit owner insurance usually includes coverage for improvements and betterments. If you bought a resale suite, previous owners may have made improvements you never knew about, so keep renovation records and photos of your finishes where you can find them.

Deductibles are where condo water damage gets expensive for individual owners. Section 105 of the Act lets a corporation add the lesser of the repair cost or its insurance deductible to the common expenses of an owner whose act or omission, or that of a tenant or occupant, caused damage to their own unit. Many Toronto corporations have also passed by-laws that charge the deductible back to the unit where the water originated even without negligence, and some extend it to damage caused to other units and common elements. Because water losses have driven up condo insurance costs, deductibles in some buildings run well into five figures, so the charge-back can be the largest cost an owner faces.
